This page (the "Privacy Policy" or "Policy") describes our policies and procedures for collecting, using, and disclosing your information, and outlines the security measures we've put in place to protect information you store using Upleveled Strategies, LLC's ("Upleveled Strategies," "we," "us") services — including services made available through our website, our client platform, and any other software or services we offer in connection with those services (the "Services"). By using the Services, you consent to the collection, transfer, processing, storage, disclosure, and other uses of your information described in this Privacy Policy.
What Information Does Upleveled Strategies Collect and Store?
Personal Information
When expressing interest in the Services or registering to use them, Upleveled Strategies requires you to provide personal contact information such as your name, organization name, address, phone number, and email address ("Personal Contact Information"). When purchasing the Services, we also require financial and billing information, such as billing name and address and payment method details ("Billing Information").
Data, Diagnostic & Login Information
Using Upleveled Strategies' Services, you may create, upload, store, and share information such as organization descriptions, contact and lead records, CRM data, automation workflows, email content, logos, photos, and user email addresses (collectively, "Data"). This information is stored and maintained on Upleveled Strategies' platform. If you encounter technical errors while using the Services, we may request permission to obtain a crash report and related logging information documenting the error ("Diagnostic Information"), which may include operating system, hardware, and browser version information, and your email address if provided. Certain login information may be stored locally on your device (not on our servers) to streamline the login process ("Login Information").
Analytics Information
As you navigate our website and use our Services, we may collect information through tools such as cookies and web beacons ("Website Navigational Information"), including standard browser information (browser type and language), your IP address, and actions taken on our website (pages viewed, links clicked). Collectively, this is referred to as "Analytics Information."
Third-party vendors, including Google, may use cookies to serve ads based on a user's prior visits to our website or other websites. Google's use of advertising cookies enables it and its partners to serve ads to users based on visits to our site and/or other sites on the internet.
Users may opt out of personalized advertising by visiting Google Ads Settings or www.aboutads.info.
Geo-Location Information
Upleveled Strategies does not currently collect real-time geo-location information while you use the Services. If this changes in the future, we will request your permission before collecting such information.
What Does Upleveled Strategies Do With the Information It Collects?
Personal Contact Information — Used primarily to administer the Services to you and provide updates and product announcements. Consistent with our Terms and Conditions, we may use some of this information for marketing purposes, as described below.
Billing Information — Upleveled Strategies does not store Billing Information on its own servers. We use a third-party payment processor to store and process all payment-related transactions. That processor's own privacy policy governs how it handles your payment data; we can provide the current processor's privacy policy link on request.
Data, Diagnostic, and Login Information — Used solely to administer and improve the Services we provide to you.
Analytics Information — May be used, in conjunction with an analytics service such as Google Analytics, to monitor and analyze use of the Services, for technical administration, to improve functionality and user-friendliness, and to verify user authorization to process requests.
Sharing & Disclosure of Private Information
Third-Party Applications and Your Use
Upleveled Strategies may allow users to link Data to third-party platforms such as Facebook, Instagram, YouTube, and LinkedIn. Such linking is entirely at the user's discretion. Upleveled Strategies is not responsible or liable for the linking of a user's Data to such third-party platforms, or for how those platforms use such links.
Marketing and Publicity
Consistent with our Terms and Conditions, you agree to permit Upleveled Strategies to identify you as a client and to use your name and/or logo in Upleveled Strategies' website and marketing materials, unless you notify us in writing that you opt out.
Sale of Personal Information
Upleveled Strategies does not sell, rent, or trade your private information to any third party.
Service Providers and Business Partners
Upleveled Strategies may use trusted third-party companies and individuals to help provide, analyze, and improve the Services (including, but not limited to, data storage, database management, web analytics, payment processing, and content or campaign execution support). These third parties have access to your information strictly to perform tasks on our behalf, and are held to obligations similar to those in this Privacy Policy.
Non-Private or Non-Personal Information
We may disclose non-private, aggregated, or otherwise non-personal information (such as usage statistics) at our discretion.
Our Use and Disclosure of Information
Upleveled Strategies will not disclose personally identifiable information about any individual except as set forth in this Privacy Policy. This applies both to our clients and to information our clients provide to us about their own contacts. We are not limited in our use of non-personal or non-identifiable aggregate information (such as the number of clients who use our Services or the geographic distribution of our users).
We collect, store, and process personally identifiable information on servers located in the United States. Due to the nature of internet routing, your information may pass through other countries in transit. We use the information we collect to:
- Develop and deliver our Services
- Process your transactions
- Provide client support and manage your account
- Improve our products, services, and marketing
We provide access to personally identifiable information only to those who require it for the purposes above, and we do not sell or rent that information to third parties. We share it with third parties only in the limited circumstances below:
Service providers under contract who support business operations such as payment and order processing, fraud investigation, billing, information management, analytics, and public relations or marketing support for our own products and services. If content creation is part of your Services (for example, ad copy, campaign content, or social media content), we may share relevant information with contracted service providers to create, edit, and/or publish that content. These providers are contractually prohibited from using your information for any other purpose and may not share it further.
Good-faith legal and safety disclosures — where we believe disclosure is appropriate to investigate fraud or other illegal activity, to investigate violations of our Terms and Conditions, or to protect our rights or the safety of others.
Legal process — in response to a subpoena, warrant, court order, or comparable legal process. Where the request identifies a specific client or limited group of clients, we will make reasonable business efforts to notify the affected party first, where we are legally able to do so.
Affiliate program — Upleveled Strategies offers an affiliate program allowing existing clients to refer new customers. Where you are referred by an affiliate, we may share limited information with the referring affiliate solely to confirm the referral and administer any applicable commission — not your full contact or billing details, and not for the affiliate's independent use.
A successor entity, in the event of a merger, acquisition, or sale of assets — which would remain bound by this Privacy Policy until it is amended.
Where delivering our Services requires it, we may use your information to locate additional information about you — including through publicly accessible sources — solely to carry out the specific service you've engaged us for.
Data Retention
We retain your information for as long as your account is active or as needed to provide you the Services. If you wish to close your account or request that we stop using your information to provide the Services, contact our client care team to initiate account deletion. Once your account is deleted, your Data is removed from our active servers; note that there may be a delay before deletion is complete, and some Data may persist temporarily in backup copies.
Changes to This Privacy Policy
If we make material changes to this Privacy Policy, we will notify you by email at the primary address on your account and/or post the updated Policy to our website prior to the changes taking effect. You are responsible for keeping an up-to-date, deliverable email address on file and for periodically reviewing this Policy. No amendment is binding unless in writing and signed by, or posted by, a duly authorized representative of Upleveled Strategies.
In the event of a business transition — such as a merger, acquisition, or sale of assets — your personally identifiable information will, in most instances, be part of the assets transferred. We will provide prominent notice on our site for 30 days following any change of ownership or control affecting your information. If your information will be used in a materially different way as a result, you will be given a choice consistent with the notification process above.
Community
Our Services may include publicly accessible community features such as blog comments, forums, or shared resources. Any information you provide in these areas may be read, collected, and used by others who access them. Content you post in these spaces may remain visible even after you close your account.
